Agenda: County weighs Lovers Lane repairs, nonprofit donations

San Benito County supervisors are set to meet at 9 a.m. Tuesday at the County Administration Building, 481 Fourth St., to consider the following:

Nonprofit donations

County supervisors will consider approving “Community-Based Organization” funding allocations, or donations, to several nonprofit organizations for the period of July through June 2019. They include $20,500 for the Emmaus House, $12,500 for the Community FoodBank, $4,000 for Chamberlain’s Children Center, and $3,000 for CASA of San Benito County.

Lovers Lane repairs

Accept all bids for the Federal Emergency Management Agency – Lovers Lane Road Reconstruction (0.91 Miles north of Shore Road to 1.18 Miles north of Shore Road), find Granite Rock Company as the lowest responsive responsible bidder, and award a contract to Granite Rock Co.  in the amount of $358,231.

According to the detailed summary on the agenda: During the period from February 1, 2017 through February 23, 2017, severe winter storms, flooding and mudslides caused wide spread damage throughout the State of California.  These severe winter storms brought heavy rains and wind gusts up to 83 miles per hour and mudslides to San Benito causing damage to many roads throughout the County.

Lovers Lane is operated and maintained by San Benito County. Lovers Lane is approximately 17 feet wide and falls in a low area surrounded by farm land and residential properties.  During this period, flood and mudslide damage was caused due to a levee breach along Pacheco Creek with standing water for several days in the Lovers Lane Road area.

A Federal Emergency Management Agency (FEMA) E-Grants, Subgrant Application was submitted on September 20, 2017. The Notification of Obligation for Public Assistance and CDAA Grant Programs, FEMA-4308-DR-CA, Cal OES ID: 069-00000 by CalOES dated March 27, 2018 was received by the County’s Emergency Services Manager.

The plans and specifications for this project were adopted by the Board and advertised for bids on June 12. Bids were due on July 12 and three bids were received.  Staff has identified Granite Rock Company as the lowest responsive responsible bidder. The other bids received were from Monterey Peninsula Engineering in the amount of $380,934 and from The Don Chapin Company, Inc. in the amount of $544,000. The Engineer’s Estimate was $398,960.

Homeless shelter, Phase II

Accept all bids received for the Homeless Services Center Building Improvements Phase II project, find Tombleson, Inc. as the lowest responsive responsible bidder, and award contract to Tombleson, Inc. in the amount of $1.22 million.

According to the detailed summary in the agenda:

When the Health and Human Services Agency first obtained grant funding for the creation of a Homeless Services Center and purchased the building at 1161 San Felipe Road in 2016, the plan was to create a comprehensive, multi-phase project.  Phase I included the construction of a homeless shelter using a CDBG award and was completed in November 2017. Phase II design began shortly thereafter and includes staff offices, client training rooms, and kitchen and laundry facilities for the shelter.  Phase III will begin design shortly and includes transitional housing.

This Phase II project was advertised for bids in July with bids due on August 16. Three bids were received and staff identified Tombleson Inc. as the lowest responsive, responsible bidder. Construction would begin in early October and be completed in April.

Jail expansion funding

Approve additional change order authority for RMA Director in the amount of $630,000 or approximately (3) three percent of the contract total for the construction of the Jail Expansion Project.

According to the detailed summary in the agenda:

The Jail Expansion project has been under construction for nearly 11 months and has seven months remaining. At the time of contract award, the Board delegated change order authority to the RMA Director in the amount of $210,000, or approximately 1% of the total construction cost of $20,139,852. This amount has nearly been exhausted and staff requests an additional change order authority amount of $210,000 be delegated to the RMA Director. This has been an extremely successful project thus far, with executed change orders far below the industry average for a project of this type.

To ensure timely response to issues as they arise during construction, staff is requesting Board approval of an additional $630,000 (approximately 3%) in additional delegated change order authority for the RMA Director.  Taking this action allows staff to quickly address any issues that arise in the field, avoiding possible delays to the project. Without this action, all proposed change orders would require Board approval which could greatly impact the project’s schedule, which would in turn create additional costs.

Two change orders have been approved by staff thus far (Change Order 1 was approved by the Board at time of contract award for purchasing insurance):

Change Order 2 included 20 items with an extra cost of $145,157.46 and credits of $55,564, for a net extra cost of $89,593.

Change Order 3 included 16 items with an extra cost of $103,883 and credits of $1,624 for a net extra cost of $105,508.

The project’s contingency amount is more than sufficient to cover this requested change order authority. Additionally, in the coming months, staff will be bringing FF&E items (Fixtures, Furnishings & Equipment) to the Board for purchase approval.

River Parkway funding

Approve change order on the River Parkway Access Road project in the amount of $140,331.

SB-1 funds for roadwork

Accept all bids for the SB-1 0.15’ HMA Overlay Project at Two Locations (PW B-1803), find Granite Rock Company as the lowest responsive responsible bidder, award contract to Granite Rock Company in the amount of $337,500.00, approve contract and authorize the RMA Director to execute the contract upon receipt of all documents required in the Invitation for Bids, and authorize the RMA Director to issue change orders in an amount not to exceed $33,750.

On April 28,2017, the Governor signed Senate (SB) 1, known as the Road Repair and Accountability Act of 2017 to address basic road maintenance, rehabilitation, and critical safety needs on both the state highway, local streets and road system.

On May 8, 2018, the Board of Supervisors adopted the plans and specifications for the SB 1 Projects, SB 1 – 0.15’ HMA Overlay Project at Two Locations, Magladry Road from Rodriguez Court to Lone Tree Road – 0.69 Mile Overlay, Southside Road from Carousel Drive to Union Road – 0.22 Mile Overlay, and SB-1 Seal Coat (Chip) and Slurry Seal Project at Various Locations, San Felipe Road (NB) from 0.9N/Fallon Road to HWY 156 – 0.60 Mile Chip Seal, Gardena Lane from Santa Ana Road to End – 0.14 Mile Chip Seal, Nash Road from 1780’ E/O Riverside Road to PCC Bridge – 0.07 Mile Chip Seal, Ladd Lane from Southside Road to South End – 0.13 Mile Slurry Seal, Cienega Road from COP 1475’ S/O Union Road to Cienega Road Extension – 0.10 Mile Slurry Seal, found the projects are categorically exempt under CEQA Guidelines Sections 15301 and 15302, and authorized the advertisement for bids.

Bids were received on June 7, 2018 with two bids on the SB 1 – 0.15’ HMA Overlay Project at Two Locations (PWB-1803) with Granite Rock Company being the lowest responsible bidder in the amount of $337,500.00 and three bids on the SB-1 Seal Coat (Chip) and Slurry Seal Project at Various Locations with Intermountain Slurry Seal being the lowest responsible bidder in the amount of $444,459.50.

The SB-1 Funding received to date from the State will only cover the construction contract award for the SB-1 0.15’ HMA Overlay Project at Two Locations.  Staff will defer on recommending to award a construction contract to Intermountain Slurry Seal in the amount of $444,459.50 until confirmation on when additional SB-1 Funding from the State will be received.  There is a time limit on holding the contractor to their bid.

The Engineer’s Estimate on the SB-1 construction is to begin in August and to last two months.
